A car buyers guide to mississippi lemon lawes

When you buy a new car or used car under warranty, you are making a major financial investment, and you deserve to get the vehicle you paid for. As we all know, that is not always the case, and consumers often find themselves with a vehicle worth less than what was paid due to a defect/problem affecting the car's safety, operability, or value. Fortunately, Mississippi lemon law is on the side of consumers, and an experienced lemon law attorney can represent you in recovering the full repurchase price plus expenses to which you are entitled under Mississippi law.

How Do I Know if I Have a Lemon?

First off, Mississippi lemon law applies to new cars within their first year of use, as well as used cars where there is a manufacturer's warranty included with the car which is still effective (up to one year from purchase). Determining whether you have a lemon such that you should receive a repurchase is dependent on two main issues:

  • What is the problem with the car? If the issue with your vehicle is not due to a collision, abuse, or poor maintenance, and the problem affects the 1) use; 2) market value; or 3) safety of the car, then you may eligible for repurchase.
  • What has been done to address the problem? In addition to identifying an issue that affects the use, value, or safety of the car, the consumer must have made three attempts to have the dealer fix the problem, or the car must have been inoperable due to the issue for at least 15 days.

How Do I Bring a Lemon Law Claim?

If both of the above conditions have been met, a written demand must be made to the manufacturer, giving it one final chance to remedy the problem. If this is not timely done, then the consumer can bring a lemon law claim through an arbitration process or in the courts. An experienced lemon law can guide you towards a full and speedy recovery of all costs associated with the car – purchase price, tax, towing fees, etc. (minus an allowance for miles driven) – by representing you in making your demand to the manufacturer and proceeding through the dispute resolution process.
